Moore County man pleads guilty to aggravated sexual assault

LYNCHBURG, Tenn. — Jonathan Wayne Utz, 25, of Buckeye Loop Rd., Fayetteville, pled guilty to aggravated sexual assault of a minor during proceedings at the Moore County Courthouse on Monday.

The guilty plea is the result of an investigation by the Metro Moore County Sheriff’s Department that began in August 2015.

Utz was arrested on Sept. 30, 2015 and charged with rape of a child and booked into the Moore County jail.

According to Sheriff Department reports, on Aug. 8, 2015 the mother of the 4-year-old victim reported that her son told her that Utz, the victim’s uncle, had sexually assaulted him. The victim had also reported this to four other people.

The report states that the victim had gone to the health department for a preschool physical and was reportedly “shy and didn’t want to cooperate.” The victim’s last visit with Utz was on Aug. 1, 2015 and it was after that that the victim reported what had happened.

According to the report by Moore County Investigator Shane Taylor, DCS was notified and a forensic interview was scheduled. It was during this interview that the victim said his uncle would take him into the bathroom and forcefully sexually assault him.

Utz was interviewed and admitted only that the victim had spent the night with him that weekend. Following an eight-week investigation, Utz was arrested, charged and held on $100,000 bond.

In the Moore County Courthouse on Monday morning, Utz pled guilty to aggravated sexual battery, a B-Felony that carries a sentence of eight to 12 years in jail. It’s an open plea and sentencing will be determined by Judge Forrest Durard.

Utz must serve 100 percent of the sentence, must register as a sex offender, will be under lifetime supervision and will not be allowed any contact with the victim.
